Child Support Orders and Enforcement

The Office of Child Support Services helps parents or guardians get child support by asking the Family Court to:

  • Issue a child support order
  • Change a child support order

We also help collect late payments and get health insurance support from the absent parent.

Get a Child Support Order

What Is a Child Support Order?

A child support order is a legally binding document issued by a court or agency that requires one parent to make regular payments to the other for the support of their child.

How Do I Get a Child Support Order?

You must file a petition in Family Court.  The Office of Child Support Services can help you with that process.

How Is the Amount of Support Decided?

The court uses state legal guidelines to determine what a support-paying parent must pay, based on the parents' income and on the number of children involved.

Change a Child Support Order

When Can a Support Order Be Changed?

If a parent or child's life changes significantly, the OCSS can help them ask the court to change their child support order.

You can ask for a change if:

  • The parent who pays starts making more money.
  • The parent who cares for the child starts making less money.
  • The child has new needs, like costs for school or health.
  • It costs more money to raise the child than it did before.
  • The child’s way of life has changed.
  • The parent who pays can now get health insurance for the child.
What Information Do I Need to Change a Support Order?

If you want to ask the court for a change in a child support order, you must show proof documenting why you need the change. A court hearing will be held. Then, the court will decide if the amount you pay or get should be changed.

We can help parents prepare the documents they need to request a change in a child support order.

Child Support Enforcement

Do You Enforce Child Support Orders?

Yes. OCSS identifies past due accounts and takes all allowable legal actions to make sure children get all the support ordered by the court.

That means:

  • Ensuring support payments are made on time and in full.
  • Collecting additional money to make up for  payments the paying parent missed.

It also can mean making sure that the paying parent keeps up health insurance coverage for the child as ordered by the court.

What Steps Can Be Taken to Enforce Payment?

OCSS can use various tools to enforce child support orders including:

  • Income execution
  • Driver license suspension
  • Income tax refund intercept
  • Passport denial
  • Freezing financial assets
  • Lottery prize intercept
  • NYS Taxation and Finance referrals
  • Reports to credit bureaus

Other steps may also include:

  • A money judgment
  • Lien
  • Professional, business, or occupational license suspension
  • Jail
